Mr. Amit Rana, Sr. DAG, Punjab with ASI Parvinder Singh *** MANJARI NEHRU KAUL.J (Oral) The petitioner is seeking the concession of anticipatory bail under Section 482 of BNSS, 2023 in case FIR No.169 dated 15.11.2024 under Sections 115(2), 118(1), 126(2), 190, 191(3), 351(1) and 351(3) and 118(2) of BNSS, 2023, registered at Police Station, Kot Ise Khan, District Moga. On 05.12.2024, while noticing the following submissions made by the learned counsel for the petitioner, this Court had granted the concession of interim bail to the petitioner and asked him to join investigation:- “Learned counsel for the petitioner inter alia contends that the complainant allegedly sustained two injuries on his person at the hands of the petitioner and co-accused. It has been asserted that though a false case has been planted upon the petitioner, however, the alleged injury attributed to the petitioner is a Kapa blow on the backside of the petitioner’s hand, which is not a vital part of the body. LUCKY 2025.03.12 14:28 I attest to the accuracy and integrity of this document High Court chandigarh CRM-M-61095-2024 -2- On a pointed query put to the learned counsel as to whether he has ever been involved in any other criminal case of identical nature, he has replied in the negative and submitted that although he is facing trial in one case under the NDPS Act, however, there are no allegations levelled against him in the said case for offences under the Indian Penal Code.” Learned counsel for the petitioner submits that in compliance of order dated 05.12.2024, the petitioner has joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation. In view of the above, the petition is allowed and interim order dated 05.12.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
