Since petitioner has remedy of approaching Debts Recovery Tribunal (DRT) under Section 17 of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 and Mr. Siddhartha Sah, learned counsel appearing for Canara Bank, points out that petitioner had earlier approached DRT, therefore, the writ petition is disposed of with liberty to petitioner to approach the DRT. 4. Learned counsel for the petitioner submits that Securitization Application, filed by petitioner, which is numbered as SA No. 199 of 2022, was dismissed for non prosecution on 08.07.2023. 5. Petitioner shall be at liberty to apply for restoration of the securitization application, by moving appropriate application. If petitioner moves such application within 48 hours, the same shall be considered, as per law. 6. Pending application(s), if any, also stand disposed of.
