PREETI KUMARI Digitally signed by PREETI KUMARI 2 2. Case of the prosecution, in brief, is that on 13.02.2025, the OfÏcer of Police Station City Kotwali Balodabazar got a tip-off to the effect that in Village Bamhanmudi, the applicant was in possession of 37 bulk liters of illicit liquor which was later seized from the applicant. Consequently, the Police registered the offence against the present applicant as mentioned in the cause title. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He further submits that the applicant has two previous criminal antecedents registered in Crime Nos. 55/2023 and 335/2009 in which he has been acquitted, the explanation of the same has been given in paragraph No. 4(a) of this bail application. He also submits that the charge-sheet has been filed in the present case and the applicant is in jail since 13.02.2025. It is further argued by him that under Section 34(2) of the C.G. Excise Act, minimum punishment is one year and maximum punishment is three years and the conclusion of the trial is likely to take quite long time. Therefore, he prays for grant of regular bail to the applicant. 4. Learned counsel for the State/non-applicant opposes the bail application. He further submits that the applicant has two previous criminal antecedents. He has further submitted that total 37 bulk liters of illicit liquor seized from the possession of the applicant, therefore, he is not entitled for grant of bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the fact that the applicant has two previous criminal antecedents, in which he has 3 been acquitted, further the charge-sheet has been filed which is taken on record and he is in jail since 13.02.2025.
