The instant First Appeal under Section 19(1) of The Family Courts Act, 1984 has been preferred against the judgment and order dated 18.08.2018 passed by learned Principal Judge, Family Court, Ambedkar Nagar in Suit No.4328 of 2018 under Section 13(1) of The Hindu Marriage Act, whereby the plaint of the appellant has been rejected on the ground of non compliance of mandatory requirement of notional income and jurisdiction and necessary pleadings. After arguing at some length, learned counsel for the appellant prays to withdraw the instant appeal with liberty to file afresh divorce petition in accordance with law.
