Neutral Citation No. - 2025:AHC:11983-DB Court No. - 29 Case :- WRIT - C No. - 2220 of 2025 Petitioner :- Amina Respondent :- State Of U.P. & 6 Others Counsel for Petitioner :- Aqueel Ahmad,Vinit Kumar Srivastava Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. It is alleged that the petitioner is a victim of Triple Talaq, in respect of which an F.I.R is already instituted. Grievance is that petitioner is not being permitted to live in the house allotted to her by the District Administration. In respect of said grievance, petitioner has also approached the third respondent, but as no action is taken, petitioner is before this Court. Learned State Counsel submits that the dispute is a private dispute between the petitioner and private respondents. In the facts of the case, it is alleged by the petitioner that allotment was in her individual capacity by the District Administration. If that be so, petitioner's grievance can always be directed to be considered by the third respondent, after notice to respondent nos. 5 to 7. Writ petition is, accordingly, disposed of permitting the petitioner to raise her grievance before the third respondent, annexing all materials in support of his claim together with a copy of this order within a period of two weeks. Such claim of the petitioner shall be looked into and necessary action as is warranted in law, shall be taken after notice to respondents nos. 5 to 7. It is made clear that we have not examined the claim of the petitioner on merits. Whether the allotment is in petitioner's individual capacity or was in favour of someone else, is left open for examination by the respondents, at the first instance.
