Mr. Sameer Rawat, learned counsel for the petitioner. 2. The present writ petition under Article 227 of the Constitution of India is filed by the Petitioner to issue a writ, order or direction in the nature of Mandamus commanding/directing the Judge Family Court, Dehradun to expedite the proceedings of O.S. No.770 of 2024, titled as “Gaurav Johar vs. Indu Johar”, and further to decide the same within such stipulated period as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case. 3. Learned counsel for the Petitioner makes a submission that the matter is related to the matrimonial dispute; initially the case for which the prayer has been made, was instituted in the year 2019, whereby with the help of the Mediator, the parties reconciled and eventually the matter was settled between the parties. But the Respondent/defendant breached the condition of the reconciliation and thus, the Petitioner/plaintiff filed a divorce petition against the Respondent in the year 2024. The written statement has been filed on behalf of the Respondent. 4. Learned counsel for the Petitioner further submits that though, the issues in the said matter have been framed but the Respondent/defendant has been continuously trying to evade the proceedings by seeking adjournment one after 2025:UHC:8204 the other, therefore, direction may be passed according to the prayer made in the present petition. 5. In view thereof, the present petition is disposed of with a direction to the Judge, Family Court, Dehradun to expedite the proceedings of O.S. No.770 of 2024, titled as “Gaurav Johar vs. Indu Johar”, as the expeditiously as possible, in accordance with law, without granting unnecessary adjournment to either of the parties.
