CORAM: HON'BLE MR. JUSTICE C M JOSHI
ORAL JUDGMENT (PER: HON'BLE MR. JUSTICE C M JOSHI)
None appears for the appellants.
Heard learned counsel for respondent No.2-Insurance Company.
On perusal of the records, the learned Prl. Senior Civil Judge & CJM, & Commissioner for Workmen’s Compensation, Bidar (for short, ‘the Commissioner’) in the absence of any proof of wages that was received by the deceased, considered the notification issued by the Government of India under Section 4(1B) of the Employee’s Compensation Act, and proceeded to determine the compensation.
The petitioners are disputing the same on the ground that the notification of the Government of India was in the

year 2010 and the accident had taken place in the year
2018.
It is relevant to note that the after the notification dated 31.05.2010, the next notification by the Government of India is dated 03.01.2020 where the wages are fixed at Rs.15,000/- per month. In the absence of any other evidence on behalf of the employer i.e. respondent No.1, the Commissioner has determined the compensation in the light of the notification of the year 2010 at Rs.8,000/- per month.
Hence, no fault can be found with the impugned
judgment. No substantial question law arises for
consideration. Consequently, the appeal is dismissed.
