The instant petition has been preferred for seeking specific direction for expedite disposal of Case No. 9709 of 2021 (State Vs. Krishna Mohan & Others) arising out of Case Crime No. 655 of 2018 registered at Police Station Sahjawan, District Gorakhpur, wherein cognizance over the chargesheet has been taken up under Section 190 Cr.P.C. on dated 13.03.2021 itself but even after issuing summoning orders, none of the accused appeared till 21.09.2024, which is apparent from the order sheet. 3. It is highly surprising that the matter is pending since 2021 and till today, no bailable warrants/non-bailable warrants have been issued against the persons against whom cognizance has been taken up by the learned concerned court. 4. In view of the aforesaid facts and circumstances, the learned Court of Additional Chief Judicial Magistrate/Fast Track Court, District Gorakhpur/concerned court is hereby directed to ensure personal appearance of accused who have already been summoned vide order dated 13.03.2021, by way of taking all strict measures available at law and thereafter proceed for framing of charges, as expeditiously as possible, preferably within a period of 4 months from the date of presentation of a certified copy of this order. 5. However, it is made clear that specific prayer for expedite disposal of trial may be raised by the petitioner at relevant stage, if required. 6. The instant petition stands disposed of accordingly.
