GP FOR REVENUE The Court made the following: 2 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 7081/2025 ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:- “to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of respondents on petitioners’ Application vide No.DER012501538554, dated 28.01.2025 submitted for conducting sub-division and survey for fixation of boundaries for petitioners’ landed property in an extent of Ac.3.00 Cents out of Ac.21.48 cents Covered by Survey No.533/2 of Rayachoty Town and Mandal, Annamayya District as amounts to non-discharge of legal obligation conferred on them under the provisions of Andhra Pradesh Survey and Boundaries Act, 1923 and Board Standing Order 34-A and 34-B of Andhra Pradesh Board of Revenue Standing Orders and offends Articles 14 and 21 of the Constitution of India and consequently direct the respondent Nos.2 to 5 to conduct survey and fix boundaries for the aforesaid landed property and pass such other order.” 2. Though the petitioners made several allegations against the respondents, during hearing, learned counsel for the petitioners requested this Court, to issue a direction to the respondents to dispose of the application/representation dated 28.01.2025. 3. Learned Assistant Government Pleader for Revenue readily agreed to dispose of the application/representation, if any pending with the respondents. 4. In view of the submission of the learned Assistant Government Pleader for Revenue, this Court need not decide the truth or otherwise of the allegations made in the petition. This Court is 3 conscious that no such direction be issued, in view of the judgment of the Apex Court in “The Government of India v. P.Venkatesh1”, wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do not serve to the cause of justice. As the learned counsel for the petitioners himself requested to issue a direction to dispose of the application/representation dated 28.01.2025, this Court find no other alternative except to issue such direction. 5. In the result, the writ petition is disposed of, directing the respondents to consider and dispose of the application/representation dated 28.01.2025, after providing opportunity of hearing to both the parties, within a period of two (2) months from the date of receipt of a copy of this order. There shall be no order as to costs.
