1. One Subodh Kumar has filed application for impleadment on the ground that the place in respect of which dispute has been raised by the petitioners was, in fact, allotted to Subodh Kumar and it is for the said reason that the petitioner no. 1 has been directed to vacate the same.
2. In respect of other petitioners the cause of action is personal to them and it has to be examined independently. He, therefore, prays for withdrawal of the entire petition with liberty to the petitioners to file independent petitions.
3. Counsel for the respondents have no objection to the same. However, learned counsel for Subodh Kumar submits that the first petitioner should implead Subodh Kumar in case, he files any fresh petition.
4. We find the submission to have force.
5. Accordingly, the petition is disposed of as withdrawn but by providing that in case, any fresh petition is filed by petitioner no. 1, Subodh Kumar would be impleaded as a necessary and proper party.
