Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Girja Shanker Sen, learned counsel for the applicant, Mr. S.N. Tiwari, learned A.G.A. for the State and perused the record. The present application has been moved seeking anticipatory bail in Case Crime No.143 of 2019, under Sections 420, 467 and 468 I.P.C., Police Station- Sirauli, District- Bareilly, with the prayer that in the event of arrest, applicant may be released on bail.
Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case and he has an apprehension that he may be arrested in the above mentioned case, whereas there is no credible evidence against him. He further submits that the co-accused persons have also been released on anticipatory bail in (i) Criminal Misc. Anticipatory Bail Application U/S 438 Cr.P.C. No.287 of 2025 (Satya Pal vs. State of U.P. and Another) vide order dated 13.02.2025 and (ii) Criminal Misc. Anticipatory Bail Application U/S 438 Cr.P.C. submissions have been made on behalf of the applicant to demonstrate the falsity of the allegation made against him. In the instant case, considering the settled principles of law regarding anticipatory bail, submissions of the learned counsel for the parties, nature of accusation, role of applicant and all attending
facts and circumstances of the case, without expressing any opinion on merit of the case, a case for anticipatory bail is made out. The anticipatory bail application is allowed.
