[2025:RJ-JP:30588] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Review Petition (Writ) No. 72/2015 1. State Of Rajasthan Through The Chief Engineer Administration, Public Health And Engineering Depart, Government Of Rajasthan, Jaipur 2. Additional Chief Engineer, Public Health And Engineering Department, Region, Jaipur 3. Superintending Engineer, Public Health And Engineering Department, City Circle, Jaipur ----Petitioners Versus Vandana Pareek D/o Sh. Pratap Narain Vyas, Swarn Path, Mansarovar, Jaipur ----Respondent For Petitioner(s) : Ms. Mahi Yadav, AAG alongwith Mr. Aaditya Godara For Respondent(s) : Mr. C.P. Sharma HON'BLE MR. JUSTICE GANESH RAM MEENA Order 07/08/2025 1. This review petition has been filed by the review petitioner- State as regards the order dated 30.08.2012, passed by in S.B. Civil Writ Petition No.3157/2012. 2. Learned counsel for the review petitioner submits that the petitioner-Vandana Pareek was initially appointed as helper on work-charge basis and under the recommendations of the Screening Committee for regularization, she has been regularized on the post of 'Beldar'. 3. Additional Advocate General further submits that the Court, while allowing the writ petition of the petitioner-Vandana Pareek, has relied upon the order passed in the case of Lal Chand Sharma [2025:RJ-JP:30588] (2 of 2) [WRW-72/2015] Vs. State of Rajasthan & Ors.; S.B. Civil Writ Petition No. 4838/1996, decided on 02.02.2010. In the case of Lal Chand Sharma (supra), the said person was discharging the duties of Store Munshi and therefore, considering the qualification and other requirements, the Screening Committee recommended him for regularization on the post of Store Munshi, however, the petitioner-Vandana Pareek was appointed as helper, she could not be regularized on the post of Store Munshi. The Court, while allowing the writ petition, has ordered to regularize the services of petitioner-Vandana Pareek on the post of Store Munshi. Such finding and direction of the Court is contrary to the record, which is an error apparent on record and need to be rectified. 4. On perusal of the record of the writ petition, the Court finds that the office of Assistant Engineer PHED, City Circle, Mansarovar, Jaipur had issued a certificate dated 07.01.2011, which clearly speaks that the petitioner-Vandana Pareek was also discharging the duties on the post of Store Munshi since her initial date of appointment. 5. The Court, while disposing the writ petition had also considered this fact and observed that it is not in dispute that the petitioner is discharging the duties on the post of Store Munshi. 6. Having regard to the aforesaid facts and the limited scope under the review jurisdiction, this Court finds no merit in the review petition. 7. Accordingly, the same is dismissed.
