GP FOR CIVIL SUPPLIES The Court made the following ORDER: This writ petition is filed under Article 226 of Constitution of India seeking the following relief: “…pleased to issue a Writ of Mandamus or any other appropriate Writ Order or direction declaring the action of the 3rd respondent in cancellation of authorization of the petitioner without conducting any enquiry as contemplated under Clause 8(4) of the control order 2018 vide proceedings in RC. No. 377/2025-B, dated 10.03.2025 is illegal, arbitrary and violation of Articles 14, 19 and 21 of constitution of India consequently set aside the same and pass…” 2. The petitioner is a fair price shop dealer for shop No.0724021 of Guntur District. On the report submitted by the 4th respondent/Tahsildar a show cause notice was issued to the petitioner on 20.02.2025 for which the petitioner has submitted her detailed explanation on 04.03.2025. When the Phirangipuram Police Station has refused to register the complaint regarding dumping of bags, the petitioner made representation to the Collector on 10.03.2025. Without considering the same, the respondent authorities have issued the impugned proceedings cancelling the authorization of the petitioner’s fair price shop. 3. Learned Assistant Government Pleader, on instructions, submits that the show cause notice issued on 20.02.2025 was withdrawn and a separate show cause notice will be issued for which the petitioner can submit her explanation. 4. Therefore, it appears that the respondents are taking steps to issue fresh show cause notice and the explanation called from the petitioner was withdrawn. Hence, no further orders are required in this writ petition. However, the respondents are directed not to disturb the petitioner’s authorization and supply essential commodities to the petitioner’s fair price shop No.0724021 of Guntur District. 5. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
