PUBLIC PROSECUTOR 2 The Court made the following Order: Learned counsel for the petitioners submits that the marriage of 2nd respondent with the 1st petitioner was performed about 17 years back and on account of the matrimonial disputes between the 1st petitioner and the 2nd respondent, the 2nd respondent has filed a complaint against the petitioners before the Kondepi Police Station and Crime No.10 of 2024 was registered against them, for the offence punishable under Sections 498-A read with 34 of IPC. 2. Learned counsel for the petitioners further submits that the 3rd petitioner is the sister of the Accused No.1, and 2nd petitioner is the mother of the 1st Accused. It is submitted by the learned counsel for the petitioners that the 2nd and 3rd petitioners never interfered with the matrimonial issues between the 1st petitioner and the 2nd respondent. The 3rd petitioner was staying away, soon after her marriage from the family of the 1st and 2nd petitioners. 3. It is also submitted that the 2nd petitioner is aged about 65 years and her health is not co-operating with her. It is also submitted that the 2nd petitioner was living separately for the last 3 two years, and only to harass the petitioners, the 2nd respondent complaint filed. 4. Considering the submissions, this quash petition is disposed of dispensing with the presence of the petitioner Nos. 2 & 3 in C.C.No.4016 of 2024, on the file of learned Additional Judicial First Class Magistrate, Kandukur, subject to the petitioners submitting an undertaking to the learned Magistrate to appear as and when required for the purpose of trial. 4. Accordingly, the Criminal Petition is disposed of.
