The present contempt application has been filed pleading willful disobedience of the order dated 11.9.2024 passed by this Court in Matters Under Article 227 No. 9680 of 2024. It has been stated in the afÏdavit that the miscellaneous appeal filed under Order 43 has already been decided by the lower appellate court and the appeal filed by the applicant has been rejected. As the claim of the applicant for temporary injunction has been rejected both by the trial court and the appellate court, I do not think it a case for registering proceedings under the Contempt of Courts Act, 1971. The argument of the counsel for the applicant that the dismissal of the appeal is not relevant so far as taking cognizance of contempt is concerned, is not acceptable.
