The instant petition has been filed for following reliefs:- i) TO ISSUE a writ, order or direction in the nature of mandamus commanding and directing the respondent no. 2 i.e, Tehsildar, Tehsil Padrauna, District Kushinagar to consider and decide the Mutation Proceeding vide Case No. T202405440105058 (Rajiv Kumar Pandey Vs Umeshwar Pandey) under Section 34 of U.P. Revenue Code, 2006 in pursuance of the dictum passed by this Hon'ble High Court on 10.05.2024 in matter under Article 227 of the Constitution of India No. 8279 of 2022, as expeditiously as possible. ii) TO ISSUE any other & further order, as this Hon'ble Court may deem fit & proper in the facts and circumstances of the present case. iii) TO AWARD costs of the writ petition to the Petitioner. 3. Learned counsel for the petitioner submitted that the mutation filed by the petitioner before the respondent no. 2-Tehsildar, Tehsil Padrauna, District Kushinagar is pending since 07.06.2024. He placed a copy of the R.C. Prapatra-11 prepared under of the U.P. Revenue Code Rules, 2016 [Rule-33(1)] which is annexed as annexure no. 1 to the instant petition. 4. Considering the facts and circumstances of the case, the instant petition is finally disposed of directing the respondent no. 2-Tehsildar, Tehsil Padrauna, District Kushinagar to decide the aforementioned proceeding, after affording proper opportunity of hearing to the parties expeditiously, preferably within a period of three months from the date of production of a certified copy of this order.
