MEDAPATI SANTOSH REDDY Counsel for the Respondent(S): 1. GP FOR REVENUE (AP) The Court made the following: 3 THE HONOURABLE SRI JUSTICE T.C.D.SEKHAR WRIT PETITION NO. 7899 of 2020 ORDER: The petitioner claims that initially the land admeasuring an extent of Ac.0.80 cents in Survey No.642/6A of Ithepalli Village, Chandragiri Mandal, Chittoor District was assigned in favour of her grandmother. After the demise of the original assignee, the petitioner claims that she inherited the subject land through succession. It is case of the petitioner that the respondents 4 to 6 visited the subject land and insisted the petitioner to vacate and deliver the vacant possession. When the petitioner questioned the same, it was informed that the subject land is required for governmental schemes. It is further case of the petitioner that despite showing them, the copy of the DKT Patta issued in favour of petitioner’s grandmother, the respondents tried to interfere with her possession. Since the respondents without issuing any notice and without following the procedure contemplated under law, interfered with her possession, the present writ petition came to be filed. 2. This Court by order dated 20.03.2020 directed the respondents not to dispossess the petitioner from the subject land. The said interim order is subsisting as on today. 3. During the course of hearing, the learned Assistant Government Pleader for Revenue would submit that the respondents are not interfering with the possession of the petitioner and there is no 4 proposal to acquire the subject land for any governmental schemes. The said submission is placed on record. 4. Having regard to the submissions made by the learned counsel on either side, this Court feels that it is appropriate to dispose of the present writ petition directing the respondents not to dispossess the petitioner from the subject land i.e., an extent of Ac.0.80 cents in Survey No.642/6A of Ithepalli Village, Chandragiri Mandal, Chittoor District, except in accordance with law. 5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
