This writ petition has been filed with the following prayer:- "i. to issue a writ, order or direction in the nature of mandamus commanding the respondent no. 3 and 4 to take necessary action and granted lease in favour of petitioner according to law of pond nos. 1523Ka area 1.117 hectare relating to village Khukhundu Tehsil Salemenpur, District Deoria. ii. to issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to decide the representation of the petitioner dated 22.11.2024 with the speaking order." 2. Petitioner contends that advertisement was made in daily newspaper for fisheries rights in respect of Village-Khukhundu, Tehsil Salemenpur, District Deoria. According to him, application were invited in which six persons had shown their interest. Four of them withdrew from auction proceedings leaving behind the petitioner and respondent no. 6. Petitioner had made a serious objection against respondent no. 6 that he was already granted fisheries right in the previous auction and had defaulted in payment. According to him, he should have been given the benefit as per Sub Rule (7) of Rule 57 of U.P. Revenue Code Rules, 2016. 3. Learned Standing Counsel has informed that till date no auction has taken place. 4. This Court finds that no such direction can be issued for consideration of the representation of petitioner. The revenue authorities are hereby directed to proceed with the auction and whosoever wants to participate in the auction may take part in the bid. 5.
