Learned counsel appearing for the petitioner submits that during the pendency of the writ petition, on attaining the age of superannuation, petitioner had retired from service. However, the impugned order of withholding annual grade increment without cumulative effect has affected his right to be considered for promotion to higher post. 2. It has been informed that aggrieved by non- promotion of the petitioner he has filed another S.B. Civil Writ Petition No. 4457/2008. 3. Learned counsel for the petitioner, on instructions, seeks permission to withdraw the instant writ petition with liberty [2025:RJ-JP:31826] (2 of 2) [CW-18500/2011] to raise all the points, raised by the petitioner in the instant petition, in the pending writ petition No. 4457/2008. 4.
