For Petitioner : No Appearance For Respondents : Mrs. A.Madhumathi Special Government Pleader https://hcservices.ecourts.gov.in/hcservices/ O R D E R This Writ Petition is filed for the issuance issue a Writ of Ceriorarified Mandamus to call for the records pertaining to Notice B3/12160/91 dated 13.06.1991, issued by the second respondent and its consequential Notice RCA2/20139/91 dated 30.09.02 and quash the same and in consequence to direct the respondents to allot the land comprised in T.S.No.12/2 900 sq.ft. situated at Plot No.8, 99/B, Velacherry Road, Adyar Village, Guindy, Chennai – 32, to the petitioner as per the Tamilnadu Urban Land (Ceiling and Regulation) Act 1976. 2. When the matter was listed earlier on 04.01.2021, there was no representation for the petitioner. Hence this Court directed this matter to be listed on 06.01.2021 under the caption “For Dismissal”. Even today, there is no representation for the petitioner. This Court finds that the Writ Petition is filed by a person who is not the owner of the property challenging the proceedings of second respondent under Tamil Nadu Urban Land (Ceiling and Regulation) Act, 1978. This Court has no reason to keep this matter pending when the petitioner or the learned counsel appearing for the petitioner is not interested in pursuing the case. 3. Accordingly, this Writ Petition is dismissed for non- prosecution. No costs. Registry is directed to issue a copy of this order to the petitioner, free of cost.
