...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to to issue a Writ of Mandamus or any other appropriate writ declaring that the action of the respondent CID police in registering and investigating in.o FIR No.13 of 2020, dated 26.02.2020, which is consisting of same and similar set of allegations as found in FIR No.1 of 2020, dated 06.01.2020, is arbitrary and without jurisdiction and consequently set aside the same in terms of the law laid down by the Supreme Court in AIR 2001 SC 2637 and direct the respondents not to proceed further with the investigation of FIR No.13 of 2020 and further direct the respondents not to interfere with the personal liberty of the petitioner and grant IA NO: 1 OF 2020 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to grant stay of all further proceedings including arrest of the petitioner in FIR No.13 of 2020 of CID Police, dated 26.02.2020, pending disposal of the writ petition and grant Counsel for the Petitioner:

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer:
“…..to issue a Writ of Mandamus or any other appropriate writ declaring that the action of the respondent CID police in registering and investigating in.o FIR No.13 of 2020, dated 26.02.2020, which is consisting of same and similar set of allegations as found in FIR No.1 of 2020, dated 06.01.2020, is arbitrary and without jurisdiction and consequently set aside the same in terms of the law laid down by the Supreme Court in AIR 2001 SC 2637 and direct the respondents not to proceed further with the investigation of FIR No.13 of 2020 and further direct the respondents not to interfere with the personal liberty of the petitioner and grant……”
2. Sri M/S Bharadwaj Associates, learned counsel for the petitioners would submit that as per the instructions from the party, they wanted to withdraw this Writ Petition.

Learned counsel for the respondents is in attendance.
4. Recording the submission made, the Writ Petition is dismissed as withdrawn. However, the petitioner is at liberty to recourse his remedy before the appropriate forum according to law. There shall be no order as to costs.
