Neutral Citation No. - 2025:AHC:6312-DB Court No. - 29 Case :- WRIT - C No. - 43669 of 2024 Petitioner :- Vijay Bahadur Chaudhary Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Shri Niwash Yadav Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Heard learned counsel for the petitioner. In view of the order proposed to be passed, we do not deem it necessary to issue notice to the private-respondents. The present writ petition is preferred by the petitioner who is complainant and has made a detailed complaint to the District Level Caste Scrutiny Committee headed by the Chairman/District Magistrate, Mau indicating therein that the third respondent actually belongs to OBC category and has illegally procured the caste certificate of Scheduled Tribe. His complaint has not been examined by the District Level Caste Scrutiny Committee headed by the Chairman/District Magistrate, Mau, for long. Hence this writ. Learned State Counsel contends that factual dispute raised by the petitioner in respect of scheduled tribe status granted to 3rd respondent can always be examined by the District Level Caste Scrutiny Committee, at the first instance. In view of the above proposition, we permit the petitioner to approach 2nd respondent annexing all materials in support of his claim with respect to incorrect caste certificate having been issued to 3rd respondent. Respondent no.2 shall issue notice to 3rd respondent and after affording an opportunity to him pass order on the complaint, in accordance with applicable statutory provisions, within a period of four months, thereafter. Accordingly, the instant writ petition is disposed of. Order Date :- 15.1.2025 rkg Digitally signed by :- RAKESH KUMAR GAUTAM High Court of Judicature at Allahabad
