Neutral Citation No. - 2025:AHC:24704 Court No. - 10 Case :- WRIT - A No. - 21020 of 2024 Petitioner :- Sharif Khan Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Yogendra Kumar Srivastava Counsel for Respondent :- C.S.C.,Jamil Ahmad Ansari Hon'ble Saurabh Shyam Shamshery,J.
1. The petitioner before this Court has claimed that on his complaint, an inquiry was initiated against Ad-hoc Principal of concerned college in regard to an allegation of financial embezzlement of deposit of money of PTA (Parent Teacher Association). 2. Sri Yogendra Kumar Srivastava, learned counsel for petitioner submits that according to inquiry report, irregularity was pointed out, however, the Ad-hoc Principal (respondent No.6) was pardoned only on ground that amount though withdrawn was not utilized and a warning was issued not to repeat such act. 3. Learned counsel further submits that punishment appears to be not proportionate to the outcome of the inquiry. 4. Sri Ashok Khare, learned Senior Counsel assisted by Sri Jamil Ahmad Ansari, learned counsel for respondent No.6 and learned Standing Counsel for State submits that petitioner has no locus to file this writ petition. He has not participated in inquiry and since a categorical finding was returned that amount withdrawn was not utilized for any other purpose, therefore, it may be considered as an irregularity but not a case of financial embezzlement otherwise also said Ad-hoc Principal has been put on warning. 5. I have considered the above submissions and find more merit in the argument of learned Senior Counsel for respondent No.6 and the State that petitioner has no locus to challenge the order impugned, however, the Court also takes note that the findings returned in inquiry report that respondent Ad-hoc Principal has withdrawn money irregularly though it has not been utilized, therefore, on facts it may not be a case of financial embezzlement but a serious irregularity was definitely committed. 6. Still considering that since a warning has already been issued, therefore, at this stage, there is no ground to interfere with impugned order, however, the respondent Ad-hoc Principal (respondent No.6) is put on caution that he is required to conduct the financial duties in a proper manner and not to repeat such irregularity in future. 7. Accordingly, writ petition is disposed of with aforesaid observation. 8.
