Neutral Citation No. - 2025:AHC:36860-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 2382 of 2024 Petitioner :- Nand Kumar Mishra Respondent :- State of U.P. and 6 others Counsel for Petitioner :- Jayendra Kumar Mishra Counsel for Respondent :- C.S.C., Ankit Gaur (S.C.) Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J.
1. This petition, purportedly in public interest, has been filed by the petitioner seeking a direction to the respondents to investigate misappropriation of funds allocated in Gram Panchayat - Bhagesar, Block - Koraon, District - Prayagraj during the year 2016-17 to 2020-21. A further prayer has been made seeking a direction to the respondents to decide the representation dated 07.02.2024 and 06.09.2024.
2. Allegations have been made that respondent No. 7 was Pradhan of the Gram Panchayat during the period of 2016-17 to 2020-21 and various amounts under 4th State Finance Commission and various Schemes were sanctioned, which have been misappropriated by the said respondent and therefore, an inquiry needs to be ordered in the case.
3. A perusal of the record indicates that petitioner has filed two complaints dated 07.02.2024 and 06.09.2024 (Annexure No. 8). In the complaint dated 07.02.2024, the grievances pertained to non- supply of information sought under Right to Information Act, 2005, which application was filed in the year 2023 and prayer was made to hold inquiry for the period 2016-17 to 2020-21 and in the
complaint dated 06.09.2024, absolutely vague allegations have been made alleging corruption and misappropriation of funds.
4. Filing of a PIL with such cursory allegations, without any specific allegations, without any specific material and filing documents, which appears to have been procured only with a view to fish out something against the Pradhan, whose tenure was long over in the year 2021, cannot be termed as a public interest.
5. Consequently, we do not find any good reason to entertain the present petition. The same is, therefore, dismissed. Order Date :- 12.3.2025 Mukesh Pal (Kshitij Shailendra, J) (Arun Bhansali, CJ) Digitally signed by :- MUKESH PAL High Court of Judicature at Allahabad
