(2) Petitioner is a person with disability as, according to his disability certificate, his visual disability is to the extent of 50 per cent. He participated in a selection for the post of Village Panchayat Development Officer, held by Uttarakhand Subordinate Service Selection Commission. According to petitioner, he was declared successful in the written examination held on 31.12.2023, however, now, his candidature has been rejected only on the ground that he could not appear before the Commission for documents verification within the deadline. (3) Learned Counsel for the petitioner submits that petitioner resides in a remote village in Tehsil Okhalkanda of District Nainital, which was cut off from the mainland due to heavy rain and landslides, therefore petitioner could not receive timely information regarding the notification issued by the selecting body concerning the last date fixed for documents verification. Learned Counsel thus submits that having regard to the facts and circumstances of the case and also in view of the disability suffered by the petitioner, a lenient view deserves to 2025:UHC:8234 be taken. (4) Mr. B.D. Pande, learned Counsel appearing for the Commission, however, relies upon a judgment dated 28.8.2025 rendered by this Court in Writ Petition (S/S) No. 1420 of 2025, in which this Court permitted the similarly situate candidate to make representation seeking to extend the deadline for documents verification. (5) Having regard to the facts of the case, writ petition is disposed of in terms of the order dated 28.8.2025. Since petitioner has already made a representation on 29.8.2025, therefore, the Secretary, Uttarakhand Subordinate Service Selection Commission is directed to take decision thereupon within ten days from the date of receipt of certified copy of this order.
