2. Mr. Rajesh Sharma, Standing Counsel for the Union of India / respondent no. 2.
3. Petitioner is a borrower, who is facing proceedings under SARFAESI ACT,
2002. By means of this writ petition, petitioner has sought the following reliefs:-
“a) Issue a writ, order or direction restraining Respondent No. 1 from taking any further coercive steps pursuant to the Section 13(2) notices dated 14.12.2022 and 15.01.2024, and the Section 13(4) possession notices dated 24.03.2023 and 09.07.2024, in respect of the Petitioners' property (92.283 sq. mtrs; Sale Deed No. 11813 dated 29.10.2007; Chao Mandi, Roorkee, District Haridwar);
b) Direct Respondent No. 1 to grant reasonable time and to accept deposits from the Petitioners towards arrears in a time-bound schedule to be fixed by this Hon'ble Court, with consequential regularisation of the loan account upon compliance;
c) Direct maintenance of status quo with respect to the title and possession of the secured asset and restrain Respondent No. 1 from taking physical possession or initiating any sale/auction pending compliance with the Court- fixed repayment schedule.”

4. Mr. Rajesh Sharma, learned counsel appearing for respondent no. 2 submits that petitioner has statutory remedy under Section 17 of SARFAESI ACT,
2002.
5. This Court finds substance in the said submission. Against possession notice, issued under Section 13(2) of the SARFAESI ACT, remedy is by approaching the Debts Recovery Tribunal under Section 17 of the Act.
6. The writ petition is, therefore,
disposed of with liberty to petitioner to approach the appropriate forum.
