Heard learned counsel for the petitioner and Mr. Anjani Kumar Chaurasiya, learned Additional Chief Standing Counsel for the State-respondent. 2. The instant petition has been filed for following relief:- I. Issue a writ, order or direction in the nature of mandamus directing and commanding the respondent No. 2/ Commissioner, Gorakhpur Division, Gorakhpur, to decide the First Appeal No. C202405000001787 (Gyan Prarkash vs. Vishwanath & others), under Section 207 of the U.P. Revenue Code, 2006, within stipulated time which this Hon'ble Court may be fixed. 3. Learned counsel for the petitioner submitted that an appeal under Section 207 of U.P. Revenue Code 2006 filed at the instance of the petitioner is pending before respondent No. 2/Commissioner, Gorakhpur Division, Gorakhpur, since 26.09.2024. He further placed a certified copy of the order-sheet of the proceeding, which is annexed as annexure-2 to the writ petition in order to demonstrate that the aforementioned proceeding is still pending. 4. Considering the facts and circumstance of the case, the instant petition is finally disposed of directing the respondent No. 2/Commissioner, Gorakhpur Division, Gorakhpur, to decide the aforementioned proceeding after affording proper opportunity of hearing to the parties expeditiously, preferably, within a period of three months from the date of production of a certified copy of this order before him.
