Neutral Citation No. - 2025:AHC:38725 Court No. - 4 Case :- WRIT - A No. - 20816 of 2024 Petitioner :- Ratnesh Kumar Singh Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Akhilesh Chandra Srivastava,Dileep Kumar Vishwakarma Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. By means of present petition filed under Article 226 of the Constitution, petitioner has questioned the suspension order. Upon pointed querry being made, learned counsel for the petitioner could not say with confidence that charge-sheet has been served upon the petitioner or not. Learned Standing Counsel has obtained instructions in the matter and as per instructions, charge-sheet was sought to be served upon the petitioner, but the same was refused by him on 09.12.2024 on the ground that petitioner wanted magisterial enquiry and not departmental enquiry but there is no such prayer in the writ petition. In such above view of the matter, therefore, I decline to grant indulgence in the matter at this stage. However, it is provided that petitioner shall be served with charge sheet within two weeks from today, which the petitioner would accept and then submit his reply within next two weeks' time. The disciplinary proceedings shall be brought to its logical end within a further period of two months. Subsistence allowance including arrears, if any. shall be paid within 30 days from the date of production of certified copy of this order. It is further provided that petitioner shall be cooperating with disciplinary proceedings and in the event petitioner cooperates and despite cooperation rendered by petitioner, respondents are not able to conclude the disciplinary proceedings within the time prescribed for, above the order dated 7.12.2024 placing the petitioner under suspension shall automatically stand revoked. With the aforesaid observations and directions, this petition stands disposed of. Order Date :- 17.3.2025 Sanjeev Digitally signed by :- SANJEEV RANJAN High Court of Judicature at Allahabad
