Hon'ble Ashwani Kumar Mishra,J. Hon'ble Vipin Chandra Dixit,J. 1. Heard learned counsel for the petitioners and learned Standing Counsel appearing for respondents. 2. While entertaining this writ petition, following order was passed on 9.1.2025. "We call upon learned Standing Counsel to obtain instructions particularly with reference to assertions made in Para-20 of the writ petition. The respondents will also disclose as to whether any decision has been taken on the application of the petitioner for grant of permission to donate his kidney for his ailing brother. Put up as fresh before appropriate Court on 21.01.2025." 3. Instructions are received from the Chief Medical Officer, Ghaziabad, according to which, petitioners were issued notices by the Chief Medical Officer on 13.1.2025 for the medical examination of doner(petitioner No.1) alongwith donee(petitioner No.2). On 15.1.2025, the petitioners without getting primary medical tests conducted, left the hospital. It is submitted that on account of non-cooperation of petitioner No.1, the prayer for grant of permission to donate his kidney to his brother-petitioner No.2 could not be processed. Communication from Max Healthcare hospital has also been annexed. Copy of instruction is furnished to the learned counsel for the petitioner today. 4. In that view of the matter, we permit the petitioners to approach the Chief Medical Officer, Ghaziabad alongwith copy of this order within three days from today who will indicate the date and time for the petitioners' appearance before the concerned medical authorities so that necessary tests etc. are performed. The petitioners undertake to cooperate in the proceeding. Proper decision in the matter be taken within two weeks. 5. With the above direction, the writ petition stands disposed of.
