1. Heard Sri Jayant Singh, learned Advocate appearing for the petitioner and learned Standing Counsel.
2. By means of this petition filed under Article 226 of the Constitution of India, the petitioner has questioned the order of punishment, whereby, he has been reverted to minimum of the pay-scale to the post in question.
3. Learned Standing Counsel submits that on the ground that the entire enquiry was false and even the charge was not made out and it is for extraneous consideration that petitioner was subjected to demotion.
4. Learned Standing Counsel on the contrary submits that the petitioner has alternative statutory remedy to appeal because it is an order of punishment passed on merits after giving second show- cause notice of the proposed punishment.
5. Learned counsel for the petitioner could not dispute the fact that petitioner was issued with the second show-cause notice before final order of punishment was passed.
6. In the given facts and circumstances, I decline indulgence in this petition at this stage.
7. However, it is provided that in the event petitioner prefers statutory appeal before the appropriate authority within a period of 3 weeks from today, the same shall be disposed of within a further 2 months' time after giving full opportunity of hearing to the parties, without granting any unnecessary adjournments.
8. With the aforesaid observations, the petition stands disposed of. Order Date :- 6.2.2025 S.A. Digitally signed by :- SALMAN AHMAD High Court of Judicature at Allahabad
