Present C528 application is filed with the prayer to quash the summoning order dated 01.09.2023 passed by learned Judicial Magistrate, Bhikiyasain, District Almora in Crl. Case No.72 of 2023, State v. Joginder Singh and another, u/s 504 & 506 IPC, and with a further prayer to quash the entire proceedings of aforesaid case. 5. A joint compounding application (IA/1/2025) is also filed in the matter, wherein it is prayed to compound the offence between the parties for the offence u/s 504 & 506 IPC, pending before the said Court on the basis of compromise arrived at between the parties. 6. Applicant no.1-Sri Joginder Singh, applicant no.2-Smt. Kamla Devi and respondent no.3-Smt. Radha Bisht (informant) are present before this Court, duly identified by their respective counsel. It is stated in the compounding application that the parties have settled the dispute amicably and respondent no.3 does not want to prosecute the applicants. 7. Having heard learned counsel for the parties and going through the affidavits filed in support of the joint compounding application, it transpires that since the parties have settled their dispute amicably, therefore, there will be no useful purpose for keeping this criminal case pending and it will be a futile exercise to ask the applicants to appear before the learned trial court as accused to face the trial. 8. In this view of the matter, compounding application is allowed. Consequently, the summoning order dated 01.09.2023 as well as entire proceedings of Crl. Case No.72 of 2023, State v. Joginder Singh and another, u/s 504 & 506 IPC, pending in the court of learned Judicial Magistrate, Bhikiyasain, District Almora are hereby quashed. Resultantly, FIR No.01 of 2023, pursuant to which charge sheet dated 26.05.2023 was filed and the said charge sheet shall also stand quashed. 9.
