Applicant has filed this application under Section 407 Cr.P.C. seeking transfer of Criminal Case No. 20404 of 2023 titled : State vs. Pradeep Kumar Singh and others, arising out of Case Crime No.110 of 2022, under Sections 498-A, 323, 504, 506, 34 I.P.C. and Section 3/4 Dowry Prohibition Act, Police Station Madhuban, District Mau, pending before the Judicial Magistrate/ F.T.C. (Offence Against Women), Mau to the any other court of competent jurisdiction at Mirzapur. Learned counsel for the applicant has argued that the applicant has a minor child, therefore, it is difficult for her to pursue the case at Mau and it would be in the interest of justice, if the pending trial is transferred to Mirzapur where another case for maintenance is pending adjudication. During the course of hearing, it is not disputed by learned counsel that the FIR was lodged by the applicant herself at Mau, therefore, the sole ground of convenience of complainant is not sufficient for transfer of the case, who at best is only a witness and her interest is represented by State. The application is dismissed.
