The present writ petition has been filed with the following prayers :- “(I) Issue a writ, order or direction in the nature of mandamus commanding the Respondents, particularly the District Magistrate Nainital to take a final decision on the application moved by the Petitioner on 26- 12-2023 seeking issuance of a Licence for acquisition and possession of firearms and ammunition under section 3 read with section 13 of the Arms Act, 1959 and issue such license to the Petitioner forthwith. (II) Issue any suitable writ, order or direction, which this Hon'ble court may deem fit and proper on the basis of the facts and circumstances of the case. Heard Mr. Sanjay Bhatt, learned counsel for the petitioner and Mr. Devendra Pant, learned Standing Counsel for the respondents. 3. Mr. Devendra Pant, Advocate, on instructions, has submitted that the petitioner’s application dated 26.12.2023 has been rejected by District Magistrate, Naininal, the respondent no.2, vide order dated 20.12.2024. 4. Mr. Sanjay Bhatt, Advocate, has requested to permit the petitioner to withdraw the present writ petition with liberty to challenge the order dated 20.12.2024. 5. The said request has not been opposed by the Mr. Devendra Pant, Advocate. 6. The present writ petition (WPMS No. 2470 of 2024) is dismissed as withdrawn granting liberty to the petitioner to challenge the order dated 20.12.2024, passed by the respondent no.2, but in accordance with law. __________________ ALOK KUMAR VERMA, J.
