The applicant is in judicial custody in FIR No.245 of 2018, dated 23.11.2018, under Sections 420, 120-B, 465, 466, 467, 468 and 471 IPC, Police Station Dalanwala, District Dehradun. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

Learned counsel for the applicant would submit that the named accused have already been enlarged on bail; the FIR pertains to the year 2018; now the applicant is implicated in the case without any basis; the applicant is neither beneficiary nor signatory to any document; even the proceedings of the case against the co-accused has been stayed by this Court.

Learned State Counsel admits that the co- accused, who are named in the FIR, have been granted bail. It is also admitted that the proceedings of the criminal case against the co-accused, has already been stayed by this Court.

The bail rejection order records that the co- accused Rajeev Deol and Kuldeep Singh, having similar role, their bails have been rejected by the trial court, but it is admitted that those co-accused have already been granted bail by this Court.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
