THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA
WRIT PETITION NO: 6990/2025
This Court made the following
ORDER:
The Writ Petition under Article 226 of the Constitution of India is filed by the Petitioner for the following relief:
“..to issue a writ order or direction more particularly one in the nature of Writ of Mandamus declaring the impugned Notices issued by the 4 Respondent vide Lr.No.34/2025/SA/ Dated 03.02.2025 and Vide Lr No.34/2025/SA/ Dated 10.02.2025 and same was served on the Petitioners on 19.2.2025 is illegal, arbitrary and violative of Article 14, 21 & 300-A of Constitution of India and contrary to the provisions of the A.P Land Encroachment Act, 1905, and consequently direct the respondents to grant pattas to the extents (As mentioned in Annexure) occupied and cultivating by the petitioners and to pass..”
2. Though the petitioners made several allegations against the respondents, during hearing, learned counsel for the petitioners requested this Court, without touching the merits of the case, to issue a direction to the respondents to dispose of the representations dated 22.02.2025 and 24.02.2025 of the Petitioners. 3. Learned Government Pleader for Revenue readily agreed to dispose of the representations of the petitioners dated 22.02.2025 and 24.02.2025, if any pending with the authorities. ::3::
4. In view of the submission of the learned Government Pleader for Revenue, this Court need not decide the truth or otherwise of the allegations made in the petition. This Court is conscious that no such direction be issued, in view of the judgment of the Apex Court in “The Government of India v. P.Venkatesh1”, wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do no service to the cause of justice. As the learned counsel for the petitioners himself requested to issue a direction to dispose of the representations 22.02.2025 and 24.02.2025, this Court find no other alternative except to issue such direction. 5.
In the result, the writ petition is disposed of, directing the respondents to dispose of the representations 22.02.2025 and 24.02.2025 of the Petitioners within two (02) months from the date of receipt of a copy of this order by passing a speaking order. In the meanwhile, respondents are directed not to interfere with the peaceful possession and enjoyment of the Petitioners’ lands situated in Survey No.1, Chinaguduba Village, Gurugubilli Mandal, Vizianagaram District, Andhra Pradesh. No costs. Consequently, interlocutory applications pending, if any, shall also stand closed. ______________________________________ JUSTICE VENKATESWARLU NIMMAGADDA
