Heard learned counsel for the petitioners and learned Standing Counsel for the State. 2. Instant petition has been filed for the following relief: "Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to decide the Appeal No. 89 of 2022 (Satya Narayan and others Vs. Nand Lal and others) under Section 11(1) of UP Consolidation of Holdings Acft pending since 15.2.2022 before respondent no. 2 within stipulated period as fixed by this Hon'ble Court". 3. This Court directed the learned Standing Counsel to obtain instructions. In compliance of the order of this Court, instruction dated 28.2.2025 sent by Settlement Officer of Consolidation, Fatehpur alongwith copy of the order dated 30.1.2025 passed by Settlement Officer of Consolidation in Appeal is already on record of the petition. Appeal under Section 11(1) of UP Consolidation of Holdings Act filed by the petitioners has been dismissed vide order dated 30.1.2025 and copy of the order dated 30.1.2025 is annexed alongwith the instructions. 4. In view of the final order passed by the Settlement Officer of Consolidation in appeal, the instant petition has become infructuous. 5. The writ petition is dismissed as infructuous with liberty to the petitioner to challenge the order dated 30.1.2025 passed by the Settlement Officer of Consolidation, Fatehpur before appropriate forum in accordance with law.
