Neutral Citation No. - 2025:AHC:24635 Court No. - 10 Case :- WRIT - A No. - 21019 of 2024 Petitioner :- Vijay Kumar Saroj And Another Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Dileep Kumar,Prashant Sharma Counsel for Respondent :- C.S.C.,Vivek Kumar Rai Hon'ble Saurabh Shyam Shamshery,J. Heard Sri Prashant Sharma, learned counsel for petitioners and Sri Vivek Kumar Rai, learned counsel for respondent. The petitioner before this Court has not able to dispute on basis of material available that their appointment were temporary under a self financed scheme though they are working for last more than a decade, however, counsel for petitioner has not able to show any document that they were appointed against the substantive post or they have been regularized, therefore, their claim for promotion from class 4 to class 3, according to relevant service rules has no basis, therefore, prayer sought in this writ petition cannot be allowed and it is accordingly rejected. At this stage, learned counsel for petitioner submits that a fresh advertisement has been issued by respondent to fill up the substantive post of class 3, however, it is their apprehension that they will not allow to participate in the process.
Learned counsel for respondent submits that if petitioners fall within the criteria made in the advertisement, they will allow to participate. In the aforesaid, apprehension does not appear to have any basis and this writ petition is accordingly, disposed of, taking note of above submissions.
