Neutral Citation No. - 2025:AHC:28648-DB Court No. - 29 Case :- WRIT - C No. - 43026 of 2024 Petitioner :- Mahesh Chandra Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Krishna Kant Shukla Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Following orders were passed on 3.1.2025:-
"Contention is that the District Magistrate, Hathras has already informed the State Government that there is no interpolation found in the sale deed of the petitioner but despite such inquiry previously conducted by the authorities, the petitioner is being coerced to again deposit his sale deed. Learned State counsel prays for and is allowed ten days time to obtain instructions in the matter. Put up once again as fresh on 16.1.2025." Learned Standing counsel submits that on the basis of a complaint made with regard to manipulation in the contents of sale deed with the connivance of officials of the Sub-Registrar a fresh inquiry is proposed to be conducted. It is also submitted that petitioner will not have to suffer as the inquiry would be conducted in accordance with the principles of natural justice. In that view of the matter and since serious allegations are otherwise levelled, we do not deem it appropriate to interfere in the notices issued by the respondents requiring the petitioner to deposit his conveyance deed for appropriate inquiry. In the facts of the case, we however provide that the inquiry itself shall be concluded, within a period of two months, from the date of deposit of sale deed by the petitioner. It is also provided that appropriate opportunity would be given to the petitioner in the event any adverse material is found against the petitioner. With the above observation/direction, the writ petition stands
disposed of.
