Neutral Citation No. - 2025:AHC:51721 Court No. - 4 Case :- WRIT - A No. - 20731 of 2024 Petitioner :- Suman Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Shiv Shankar Kaithal Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. 1. Heard learned counsel for the parties. 2. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for a writ of mandamus commanding the respondents to consider her claim for compassionate appointment on account of her mother, namely, Rooprani, died-in-harness on 28.09.2009. 3. Learned Standing Counsel submits that petitioner is a married lady and she filed application claiming compassionate appointment quite late as the death of her mother took place in the year 2009. 4. Upon a pointed query being made, learned counsel for the petitioner submits that though both the daughters of deceased- employee, i.e., the petitioner and her sister are married but on account of some dispute of succession between the petitioner and her sister, she could not move application for compassionate appointment earlier. However, it is admitted to the petitioner that the petitioner came to make a representation claiming compassionate appointment quite belatedly. 5. In the given facts and circumstances, considering the fact that the petitioner herself has approached this Court after a lapse of more than one and half decade and it is admitted by her that she could not make an application for compassionate appointment earlier on account of certain family dispute and also the fact that petitioner is a married lady, I do not find any existing circumstance of financial crisis or dependency wherein compassionate appointment should be offered. The object of offering compassionate appointment is to provide immediate financial help to the family of the deceased employee and hence I decline to grant any indulgence in the matter. 6. The petition fails and, accordingly, consigned to records. Order Date :- 9.4.2025 Shiraz Digitally signed by :- SHIRAZ ALI High Court of Judicature at Allahabad
