Heard the parties.
The petitioner has been made accused in connection with Bishunpur P.S. Case No. 18 of 2024, for the offence registered under Sections 25 (1- B)a/26 of Arms Act. Cognizance has been taken under Sections 25 (1- B)a/26/35 of Arms Act, pending in the court of Sri Prateek Raj, learned Judicial Magistrate, First Class, Gumla. On 14.08.2024, Bishunpur Police apprehended co-accused Ashish Kachhap from an abandoned Government School at Bishunpur, Gumla. On search, a loaded country made pistol was recovered from his confession. It was submitted that petitioner was neither apprehended at the spot nor anything was recovered from his possession. It was further submitted that name of the petitioner has transpired in confession of apprehended co- accused. It was finally submitted that Ashish Kachhap from whose possession firearm was recovered, has been granted bail by this Court earlier. Learned A.P.P on behalf of the State has opposed the prayer for bail. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Prateek Raj, learned Judicial Magistrate, First Class, Gumla, or his successor, in connection with Bishunpur P.S. Case No. 18 of 2024.
