Neutral Citation No. - 2025:AHC:80848 Court No. - 33 Case :- WRIT - C No. - 42964 of 2024 Petitioner :- Bhuvaneshwar Singh Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Sharad Chand Rai Counsel for Respondent :- Avinash Chandra Srivastava,C.S.C. Hon'ble Prakash Padia,J. 1. Heard Sri Sharad Chand Rai, learned counsel for the petitioner, learned Standing Counsel appearing on behalf of State-respondent nos. 1 and 2, Sri Avinash Chandra Srivastava, learned counsel appearing on behalf of respondent no. 3 and perused the record. 2. In view of the order proposed to be passed herein, no useful purpose would be served by putting the opposite party to notice and keeping this petition pending before this Court. However, in case the opposite party feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 3. The basic relief sought by the petitioner in the present petition is to direct the respondent no. 2 to comply/implement own order dated 14.11.2024 passed by himself i.e. Sub Division Magistrate, Tehsil Bhogaon, District Mainpuri and also take necessary action against the respondent no. 4 under section 134 of U.P. Revenue Code, 2006, expeditiously. 4. It is argued that on the representation made by the petitioner under section 134 of the U.P. Revenue Code, 2006, a report was submitted by concern Lekhpal and on the basis of the same Sub Divisional Magistrate, Tehsil Bhogaon, District Mainpuri/respondent no. 2 directed on 14.11.2024 to the Nayab Tehsildar and Station House Officer, Bhogaon to remove the illegal encroachment of the respondent no. 4 in the aforesaid land and take proper action in the aforesaid matter. It is further argued that till date no final decision has been taken in the matter. 5. In view of above, with the consent of parties the present petition is disposed of directing the petitioner to serve the copy of this order alongwith the report copy of which is appended at page 28 to the present petition before the Respondent no. 2 within a period of two weeks' from today. If it is so, the respondent no. 2 take a decision in the matter pursuant to his own noting dated 14.11.2024 expeditiously and preferably within a period of two months from the date of production of certified copy before him.
