Neutral Citation No. - 2025:AHC:51479-DB Court No. - 21 Case :- WRIT - C No. - 42624 of 2024 Petitioner :- Ram Aasre Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Akash Ojha,Dharmendra Kumar Pandey Counsel for Respondent :- C.S.C. Hon'ble Manoj Kumar Gupta,J. Hon'ble Anish Kumar Gupta,J. 1. The instant petition has been filed praying for quashing of a communication dated 09.06.2023 by Executive Engineer, Gyanpur, Canal Division, Bhadohi in response to an application of the petitioner dated 01.06.2023. It is noted that joint team inspected the site on 20.03.2023 and wherein it transpired that the petitioner was in possession of 0.116 hectare of Gata no.516 and the remaining area measuring 0.146 hectare of the said plot is covered by a canal. An area measuring 0.154 hectare has already been acquired. It is established from the inspection report that the petitioner is in possession of excess land. It is also noted in the said communication that a previous writ petition filed by the petitioner being Writ-C No.35513 of 2022 was dismissed on the ground that therein the petitioner has made inconsistent pleadings. 2. Once again, the pleading contained in the writ petition are vague and inconsistent. Additionally, it is admitted to the petitioner that he has filed an application for demarcation but the fate of the said application has not been disclosed. 3. In such circumstances, we decline to interfere and leave it open to the petitioner to press the demarcation application, if so advised. 4. Dismissed with the aforesaid liberty to the petitioner.
