This Court on 31.7.2025 had passed the order in following terms :- "1. Learned Standing Counsel has produced instructions, received from the office of ARTO, Mathura. Paragraph No. 4 of the same is reproduced herein below:- "याचीकतार् ने अपने प्राथर्ना पत्र िदनांक 20.02.2025 के द्वारा वाहन संख्या यूपी 85 सीटी-0551 (बस) के प्रित िफटनेस फीस जमा करने व िफटनेस प्रमाण पत्र जारी करने का अनुरोध िकया गयाथा, के क्रम में इस कायार्लय के पत्र संख्या 4563/टीआर/नोिटस/2025, िदनांक 18.03.2025 (संलग्नक-4) के द्वारा पंजीकृ त डाक के माध्यम से व पंजीकृ त मोबाइल नम्बर परयाचीकतार्/वाहनस्वामी को िनदेर्िशत िकया गया है िक उक्त वाहन की िनधार्िरत टैक्स एवं िफटनेस फीस आनलाइन रूप से जमा करके एवं लिम्बत चालानों का भुगतान कर 07 कायर्िदवसों के भीतर अपर पिरवहन आयुक्त (राजस्व) उ०प्र०. लखनऊ के पत्र संख्या 445/सा०प्र०/2020-06 टीआर/2020, िदनांक 18 मई, 2020 द्वारा बसों / स्लीपर बसों की बॉडी के उल्लेिखत AIS 119 मानको एवं उत्तर प्रदेश मोटर यान िनयमावली, 1998 के िनयम 2 (24 ख) के अनुसार ही उक्त यान को िफटनेस नवीनीकरण हेतु सम्भागीय िनरीक्षक, प्रािविधक मथुरा के समक्ष याप्रािधकृ त परीक्षण के न्द्र में प्रस्तुत करना सुिनिश्चत करें अन्यथा िवफल होने की दशा में वाहनस्वामी याचीकतार् स्वयं िजम्मेदार होगा।" 2. Learned counsel for the petitioner states that the petitioner has deposited all the challans and nothing is due. So far as the modification in the vehicle is concerned, he submits that as per the registration certificate, the sitting capacity is 21 and sleeper capacity is 18. It is submitted that accordingly, the petitioner got constructed 21 sitting capacity and 18 sleeper capacity in the bus. Now after five years from the date of registration of vehicle a frivolous objection has been raised with regard to the sitting and sleeper capacity in the vehicle. 3. Let learned Standing Counsel produce the instructions as to what amount is due to the petitioner towards challan and why the objection which is being raised with regard to sitting capacity and the sleeper capacity in the vehicle was not raised at the time of registration of the vehicle and further what should be the sitting capacity and sleeper capacity of the bus as per the present rules. Sri Rajeshwar Tripathi, learned Additional Chief Standing Counsel, on the basis of instructions, submits that the petitioner's vehicle has been removed from blacklisting on the portal. However, he states that five challans amounting to R. 77,000/- are still pending against the petitioner and besides the aforesaid challans the petitioner is also liable to pay penalty etc. 3. Learned counsel for the petitioner disputes the same and submits that all dues have already been cleared, and the amount under the five challans which has been issued to him has been deposited. 4. In such view of the fact, the present writ petition is disposed off permitting the petitioner to file a detailed representation along with all the challans which has been paid by the petitioner before the respondent No.2, Assistant Regional Transport Officer (Admin), Mathura within a period of one month from today. In case, any such representation is filed by the petitioner, the respondent no.2 shall consider and decide the same, strictly in accordance with law within a period of one month after giving due notice and opportunity of hearing to the petitioner as the respondent no.2 finds that no amount is due to the petitioner, he shall release the vehicle of the petitioner forthwith.
