Heard Mr. A Lal as well as Mr. S M Abdullah P., the learned counsel appearing for the petitioners. Also heard Mr. B Sarma, the learned Additional Public Prosecutor for the state of Assam. 3. Both these applications are filed under Sections 482 of the BNSS, 2023 seeking pre- arrest bail in respect of Gossaigaon P.S. Case No. 49/2025. 4. The primary allegation made in the FIR is that a person was persuaded by a small boat shaped substance, which was claimed to be made of gold. Later on, it was found that it was not made of gold. 5. The petitioner Shri Azizul Hoque Sheikh was granted interim bail by this Court and pursuant to that he has already appeared before the Investigating Officer and his statement has already been recorded. 6. Therefore, since the petitioner Shri Azizul Hoque Sheikh has been co-operating with the Investigating Officer, he does not deserve to be detained in custody. Therefore, his Anticipatory Bail Application is allowed. 7. The interim bail granted on 25.04.2025 in favour of the petitioner Shri Azizul Hoque Sheikh is hereby made absolute. 8. So far as the case against the petitioner Raphikul Sk is concerned, this Court is of the opinion that the petitioner Raphikul Sk deserves to be given an interim protection. Page No.# 3/3 9. Therefore, as an interim measure, it is hereby directed that in the event of arrest in connection with of Gossaigaon P.S. Case No. 49/2025, the petitioner, namely, Raphikul Sk shall be released on bail of ₹20,000/- with a surety of like amount to the satisfaction of the arresting authority. 10. The petitioner, Raphikul Sk is directed to appear before the Investigating Officer within next 10 days from today. List AB No. 1111/2025 on 17.06.2025. The AB No. 929/2025 is disposed of.
