The petitioner has preferred the present writ petition with the following prayer:- "(a) to issue a writ, order or direction in the nature of mandamus commanding and directing respondent no. 3 and 4 to make the payment of the arrear of salary of the petitioner for the period 01.01.1986 to July, 2000 which totals to the amount of Rs. 4,45,397/- and the remaining amount of G.P.F. which is Rs. 1,02,784 to the petitioner if possible within a month. (b) to issue a writ order or direction in the nature of mandamus commanding and directing the respondents to decide the representations given by the petitioner to respondent no. 3 within the stipulated period." 2. The Instructions provided by respondent No.3/District Basic Education Officer, Ballia is already on record. 3. It is stated in paragraph 5 of the Instructions that the petitioner was placed under suspension on 05.05.1990 and after making written apology, he was reinstated in service on 31.07.2000. The paragraph 5 of the Instructions reads as follows:- 5-यह ककि उक्त किके अननुपपालन मम प्रबन्धकि , कतिलकेश्वररी दकेवरी इण्टर किपालकेज गगौरपा पतितोई , बललयपा नके अपनके पत्र कदनपानांकि 24.01.2025 (छपायपाप्रकति सनांलग) जतो व्हपाट्सएप पर कदनपानांकि 27.01.2025 कितो उपलब्ध किरपायपा गयपा हह , किके दपारपा यह अवगति किरपायपा गयपा हह ककि शरी ओम प्रकिपाश लसनांह , स०अ० किके पद पर कवदपालय मम कदनपानांकि 01. 08.1932 कितो कनयनुक्त हहयके एवनां अलधवकपरतिपा आयनु पपूरर किरकिके कदनपानांकि 31.03.2022 कितो सकेवपाकनववृति हहयके हह। कवदपालय अकभिलकेखखों / वकेतिनपनांलजकिपा किके अननुसपार मपाह फरवररी 1988 तिकि शरी ओमप्रकिपाश लसनांह कितो कनयकमति रूप सके वकेतिन भिनुगतिपान ककियपा गयपा हह। आपकिके किपायपारलय किके पवृषपानांकिन आदकेश सनां0 कनयतोजन/591-92 कदनपानांकि 01. 06.1988 किके दपारपा शरी ओमप्रकिपाश लसनांह किपा वकेतिन अवरुद्ध ककियके जपानके किकी ससस्थिकति मम मपाह मपारर 1988 सके लकेकिर मपाह अप्रहल 1990 तिकि वकेतिन बपालधति रहपा। कबनपा ककिसरी पपूवर सपूरनपा किके कवदपालय सके अननुपससस्थिति रहनके किके किपारर शरी ओमप्रकिपाश लसनांह किके कवरूद्ध प्रबनांध सकमकति दपारपा जजॉर किकी किपायरवपाहरी किकी गई। प्रबनांध सकमकति दपारपा जजॉर किकी किपायरवपाहरी मम आरतोपखों किके पनुकष्टिति पपायके जपानके किके आधपार पर शरी ओमप्रकिपाश लसनांह कितो कदनपानांकि 05.05. 1990 कितो कनलसमबति किर कदयपा गयपा। शरी ओमप्रकिपाश लसनांह किके लललखति क्षमपा -यपारनपा किके आधपार पर कदनपानांकि 31.07.2000 कितो कनलमबन कनरसति किरतिके हहयके कनरसतिरीकिरर किकी कतिलस्थि सके शरी ओमप्रकिपाश लसनांह किकी सकेवपायम बहपाल किकी गई। 4. After going through the aforesaid Instructions, the Court is of the opinion that the writ petition is liable to be dismissed with exemplary cost since the material facts were concealed by the petitioner while filing the present writ petition. 5. At this stage, a prayer has been made by learned counsel for the petitioner to dismiss the present petition as not pressed. 6. Accordingly, the present petition is dismissed as not pressed. 7. It is made clear that no liberty is granted to the petitioner to file fresh writ petition for the same cause of action. 8. Insofar as the payment of G.P.F. is concerned, the petitioner is at liberty to seek appropriate legal remedy.
