3. Principal, Bhartiya Vidya Bhawan's Vidyasharam, Opp. O.T.S., Jaipur-302015 ----Petitioners Versus
1. Shri Pankaj Mathur S/o Shri Anand Swaroop Mathur, aged about 28 years, R/o D-145, Kaushaya Marg, Banipark, Jaipur.
2. The Rajasthan Non-Government Educational Institutions Tribunal, Jaipur through its Presiding Officer. ----Respondents For Petitioner(s) : None present For Respondent(s) :
HON'BLE MR. JUSTICE ANAND SHARMA
Order 08/08/2025
1. None for the petitioners even in the second round.
2. I have examined the record of the case.
3.
Learned counsel for the petitioner has challenged the
order dated 14.02.2003 passed by the Rajasthan Non-Government Educational Institutions Tribunal, Jaipur whereby the appeal under Section 19 of the Act of Rajasthan Non-Government Educational Institution Act, 1989 (‘Act of 1989’) filed by the non-petitioner No.1 has although been dismissed, yet directions have been given for payment of remaining salary to the respondent No.1.
[2025:RJ-JP:30735] (2 of 2) [CW-7814/2003]
4. It is admitted case of the parties before the Tribunal that petitioner No.1 was although appointed on contract basis, yet his services were terminated prior to completion of term decided in the contract.
5. Hence, in these circumstances, only to the extent of payment of remaining salary, order dated 14.02.2003 has been passed by learned Tribunal.
6. No ground whatsoever has been raised in the writ petition on behalf of the petitioners to show that the order passed by the learned Tribunal is manifestly illegal or findings are perverse.
7. In view of above, we find no inference in the order passed by the learned Tribunal. The petition filed by the petitioners is hereby dismissed.
