UNION OF INDIA AND OTHERS ...Respondent(s) Through: Mr. T.M. Shamsi, DSGI with Ms Rehana Qayoom, CGC CORAM:
HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE ORDE R 23.12.2025
1. In this petition, the petitioner claiming to be the General Secretary of a Political Party is seeking to assail the Jammu & Kashmir Reservation (Amendment) Ordinance, 2019 and the Constitution (Application to Jammu & Kashmir) Amendment Order, 2019.
2. So far as the Constitution (Application in the Jammu & Kashmir) Amendment Order, 2019 is concerned, the vires of the same stands upheld by the Hon’ble Supreme Court in Re: Article 370 of the Constitution, 2023 INSC 1058. However, so far as challenge to the Jammu & Kashmir Reservation (Amendment) Ordinance, 2019 is concerned, the petitioner is neither directly nor indirectly affected, as he does not claim to be a member of any reserved category, as such lacks locus standi.
3. Be that as it may, since the petitioner has not turned up to pursue this petition, the same is accordingly dismissed for non-prosecution.
