This writ petition has been filed with the following prayers:- "I. set aside the impugned order dated 10.09.2015 passed by learned court of District Judge, Bhadohi Gyanpur in Misc. Appeal No.31 of 2015 (Jubair and others Vs. Imtiyaz Ahmad and others), "II. direct the learned court of Civil Judge (Jr. Division), Bhadohi Gyanpur to decide the impleadment application of petitioner dated 17.10.2023 pending before him within stipulated period. III. restrain the Interference of plaintiffs/respondents in peaceful possession of petitioner over gata no.451 area 0.4850 hectare situated in village Bhamaura, Tehsil- Aurai, Bhadohi, during pendency of present petition." Learned counsel for the petitioner, at the very outset, states that he is not pressing his first and third prayers made in the writ petition, and is only confining to his second prayer which is in regard to decide the impleadment application dated 17.12.2023 pending consideration in Original Suit No.219 of 2015. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction Civil Judge (Junior Division), Bhadohi to decide the impleadment application dated 17.10.2023 filed Original Suit No.219 of 2015, if there is no legal impediment and after hearing all the concerned parties, strictly in accordance with law, expeditiously, preferably within a period of three months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
