Neutral Citation No. - 2025:AHC:36420-DB Court No. - 29 Case :- WRIT - C No. - 42662 of 2024 Petitioner :- Kundan Sharma Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Akash Kumar Nishad,Subhash Chandra Pandey Counsel for Respondent :- A.S.G.I.,Rajesh Tripathi Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Heard learned counsel for the petitioner. The following orders were passed on the previous occasion: "Petitioner is seeking correction in his date of birth in the Aadhaar Card relying upon a Secondary School Examination Marksheet issued by the National Institute of Open Schooling. In the Aadhaar Card the date of birth of the petitioner is mentioned as 10.9.2002. According to petitioner his date of birth is 10.09.2004 which is also mentioned in the Birth Certificate issued under the Registration of Births & Deaths Act, 1969 and, therefore, necessary correction in the Aadhaar Card be directed to be made. Sri Rajesh Tripathi, learned counsel for the respondent, however, has produced photocopy of the High School Certificate of the petitioner, in which his date of birth is mentioned as 10.9.2002. It is stated that this document has been suppressed from this Court. Let notices be issued to petitioner to explain as to how and why the petition be not dismissed on account of concealment of facts. Let such affidavit be filed within 10 days. Put up as fresh, once again, on 12.3.2025." Today when the matter is taken up, none appears on behalf of the respondents despite repeated notices issued. In such circumstances, we find that the petition has been filed on the strength of deliberate suppression and concealment of facts. Accordingly, the present writ petition is dismissed with cost assessed as Rs.10,000/- on the petitioner. The District Magistrate, Deoria is directed to get such amount recovered as arrears of land revenue which shall be deposited in the account of the District Legal Services Authority.
