The petitioner has assailed an order dated 11.7.2023 passed by Estate Officer, NTPC, Rihand Nagar, Sonebhadra under Section 5(1) of the Public Premises (Eviction of Unauthorized Occupants) Act, 1971. 2. Sri H.P. Dubey, learned counsel for NTPC, submits that against the impugned order, the petitioner has remedy of filing appeal before District Judge under Section 9 of the Act, which could not be disputed by learned counsel for the petitioner. 3. Consequently, we decline to examine the challenge and relegate the petitioner to the alternative remedy available under the statute. 4. The petition stands disposed of accordingly.
